Texas Supreme Court Justice John P. Devine recently warned that Democrats are engaging in election rigging tactics to prevent the reelection of former President Donald Trump.
“Do you really think the Democrats are gonna roll over and let Trump be president again?” asked Devine to a crowd as the keynote speaker at the Texas Tea Party Republican Women’s 2023 Christmas event in Houston.
“Every day there are abuses to the First Amendment, religious, free speech issues and so forth,” Devine said before turning his focus on elections.
“Election laws… look at the election law abuse that happened,” he told the crowd. “We’re still fighting that. That’s still out there. It’s gonna happen again. Do you really think the Democrats are gonna roll over and let Trump be president again? [D0] You think they’re just gonna go away, all of a sudden find Jesus and [let this] be an honest election? I don’t think so. So, I think those kinds of cases are going to be back to us in this cycle.”
Election watchers believe that Devine is not alone in his conviction. For example, questions have arisen regarding the counting of illegal immigrants in Census data as this tends to benefit Democratic states when it comes to Congressional and Electoral College apportionment. But instead of taking Devine’s warnings about election rigging seriously, critics have used the speech to raise concerns about Devine’s impartiality on the bench.
Mainstream media outlets criticized the state Supreme Court Justice for echoing claims that are supposedly “unsupported” regarding Democratic Party election meddling schemes.
“The audio is a rare glimpse into Texas’ typically insular high court and window into the judicial philosophy of Devine, a former anti-abortion activist whose tenure as a jurist has been shaped by his religious beliefs and deeply conservative politics – sometimes, his critics say, at the expense of his impartiality,” wrote Robert Downen for the Texas Tribune.
Downen noted that this is not the first time that Devine has expressed his concerns regarding Texas Democrats. Back in September 2023, Devine took aim at a number of Texas officials, including by RINOs, or “Republicans In Name Only.”
These include officials in the Court of Criminal Appeals, who at the time ruled that Attorney General Ken Paxton could not unilaterally prosecute local voting crimes. He has also expressed concern over local Democratic leaders in Harris County, home to Houston. He accused Democrats here of “Democrat dirty tricks” and trying to “bastardize our election code” to steal elections.
In his speech at the Christmas event, Devine noted that courts in Texas could be hearing a lot more election cases, including in Harris County, which he previously criticized for expanding mail-in voting access during the Wuhan coronavirus (COVID-19) pandemic. Many of the county’s voting protocols were later shut down by the Texas Supreme Court.
“I think those kinds of cases are going to be back to us in this cycle,” he said.
